Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and the operator of Truck and Trailer USA (“Operator,” “we,” “us”). By creating an account, requesting an SMS code, posting, messaging, or otherwise using truck-trailer.us (the “Service”), you agree to these Terms, the Privacy Policy, the Safety page, and the Community Guidelines. If you do not agree, do not use the Service.

These Terms are not a substitute for advice from a licensed attorney. They describe how the Service is intended to work. Some waivers are limited by state law.

1. The Service is a venue only

The Service is an online classifieds board and messaging tool. It lets people advertise trucks and trailers, post jobs, and talk to each other.

We are not a motor carrier, freight broker, freight forwarder, dispatcher, moving company, insurer, escrow agent, payment processor, employer, or joint venturer with any user. We do not arrange transportation of property for compensation. We do not select, dispatch, or recommend a particular hauler for a particular load. We do not take possession of cargo or equipment.

Any arrangement to move property, tow, load, unload, or pay for that work is solely between the users involved. We are not a party to that arrangement and we do not confirm that it happened.

FMCSA has stated that merely making information about potential shippers or carriers publicly available — even if a fee is charged for the listing — is not brokerage so long as the operator is not otherwise involved in the transaction. We stay on that side of the line: listings and messages only. We do not handle money, allocate loads, or negotiate the haul.

2. No payments on this site

We do not process, hold, guarantee, refund, or collect any payment for a haul. Asking prices and bites are advertisements of what users say they want. They are not invoices from us and not a contract with us.

If you pay another user — cash, app, check, or otherwise — you do that off the Service, at your own risk. We do not mediate payment disputes, “deposits,” no-shows, damaged cargo, or incomplete jobs. Report scams; we may suspend accounts. We will not make you whole.

3. Eligibility and accounts

You must be at least 18 years old and located in the United States. You must use a US mobile number you control. One person, one phone, one account. You are responsible for activity on your account.

We may refuse, suspend, or delete an account at any time, including for suspected fraud, prohibited cargo, harassment, SMS abuse, or Terms violations. We have no duty to provide a reason.

4. Listings, bites, and messages

You represent that photos and specs you post are of equipment or loads you actually have, and that you have the right to post them. Public listings show city/state and ZIP-level location, not street addresses. Street addresses and phone numbers stay private until a user chooses to share them in a thread.

Accepting a bite does not create a contract with us. It only records that two users said they intend to work together. You still arrange details, access, loading, and payment directly.

You grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit the content you post so the Service can function. We may remove content without notice.

5. Assumption of risk and release

Meeting strangers, moving property, towing, loading, driving, and entering property are inherently dangerous. Risks include injury, death, property damage, theft, fraud, cargo loss, traffic accidents, and uninsured or underinsured users.

You assume all of those risks. You will do your own identity, equipment, insurance, and background checks. We do not verify users, vehicles, trailers, insurance, licenses, USDOT/MC numbers, or cargo. Optional fields (including any USDOT number) are self-attested. Links to FMCSA SAFER are for your own lookup; they are not our verification.

To the maximum extent permitted by applicable law, you release and discharge the Operator and its owners, officers, and agents from claims arising out of: accidents, injury, death, theft, cargo loss, user conduct, off-platform payments, equipment failure, or your use of the Service. This release does not apply to the Operator’s own fraud, willful misconduct, or any liability that cannot be waived under the law of the state where the events occur.

6. Insurance and transportation law are yours

If you haul someone else’s property for pay, you may be a for-hire carrier. Personal auto policies often exclude for-hire use. Combined vehicle-and-trailer weight, interstate trips, household goods, and CDL thresholds can trigger USDOT numbers, MC authority, insurance filings, hours-of-service, and marking rules. That is your problem to solve with your insurer, your state’s DMV, and FMCSA — not ours.

We do not license you. We do not tell you that a trip is legal. If a job would require authority or insurance you do not have, do not take it.

7. Prohibited use

You will not use the Service for: hazardous materials or anything requiring a placard; transporting people as cargo; stolen property; weapons, explosives, or illegal goods; household-goods interstate moving as a licensed mover unless you actually hold that authority and say so honestly; spam, scraping, or SMS pumping; impersonation; harassment; or any crime. We may report illegal activity.

8. SMS

By requesting a login code you consent to receive account-verification SMS at the number you provide. Those messages are required to operate the account. Message and data rates may apply. Frequency is limited (we rate-limit sends).

Optional “new message” alerts are off by default. If you turn them on in Account, you consent to receive a digest SMS no more than about once per 15 minutes when you have unread mail. The text will not include message bodies or addresses. Turn the toggle off to stop. Carrier STOP/HELP handling may also apply to the long-code used for alerts.

We use Twilio as our SMS processor. Do not request codes for a number you do not control.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY USER, LISTING, OR HAUL WILL BE SAFE, LEGAL, TIMELY, OR AS DESCRIBED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CARGO, OR PERSONAL INJURY ARISING FROM USER CONDUCT, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED US DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE THREE MONTHS BEFORE THE CLAIM. YOU HAVE PAID US NOTHING TO USE THE SERVICE.

Some states do not allow certain limitations. In those states, our liability is limited to the greatest extent allowed.

11. Indemnity

You will defend, indemnify, and hold harmless the Operator from claims, damages, and reasonable attorneys’ fees arising out of your use of the Service, your content, your equipment, your hauls, your payments to or from other users, your violation of law or these Terms, or injury to any third party in connection with a meeting or job you arranged through the Service.

12. Privacy

Our Privacy Policy explains what we collect (including your phone number and ZIP) and that we do not sell personal information. Public profiles never show your phone or street address unless you share them in a private thread.

13. Changes, termination, and survival

We may change these Terms. The version date at the top will change. If you have an account, we may require you to accept the new version before you keep using the Service. Continued use after the effective date is acceptance. Sections 1–2, 5–11, 14, and this survival clause continue after your account ends.

14. Governing law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules, except that the enforceability of any release of personal-injury claims is governed by the law of the state where the underlying events occurred.

You agree to the exclusive jurisdiction of the state and federal courts located in Connecticut for disputes with the Operator about the Service, except where prohibited. You and we each waive a jury trial to the extent permitted by law. Nothing here requires you to waive claims that cannot be waived.

15. General

If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement about the Service. You may not assign your account. We may assign the Service. Failure to enforce a term is not a waiver. Headings are for convenience only.

Notices to us may be sent through the Service or via TheIT.Guru. Notices to you may be posted in the Service or sent by SMS to your account number.
